HP is facing a class action for misleading and false advertisements in California.
Legal NewsLine reports that a complaint was filed alleging HP breached the California False Advertising Act and the Unfair Business Practices Act. The plaintiff, Anthony Fehrenbach, claimed he had paid for the HP Smart Install feature but it was not automatically installed via the Internet as the OEM advertised.
Mr. Fehrenbach alleged that HP made a misrepresentation and fake advertisement, and also maintained to have suffered massive financial loss for the feature. He is now seeking the certification of the case as a class action and requires compensation for actual damages, punitive damages, attorney fees and court costs, with pre- and post-judgment interest.
