Ink Cartridges Subject to Seizure and Forfeiture Order

The Florida-based United Toner LLC has been issued a Seizure and Forfeiture Order, for violating General Exclusion Order (GEO) related to No. 337-TA-723 investigation.

United Toner had been trying to import “certain Inkjet cartridges,” but they were denied entry into the USA by the Bureau of Customs and Border Protection (“Customs”). Customs informed the International Trade Commission that it has denied entry of the cartridges. Based on supplementary documents, the Commission has upheld the issuance of the seizure and forfeiture order.

According to the orders, dated March 30, provided to RT Media, “ink cartridges with printheads and components thereof from United Toner LLC violated the GEO related to No. 337-TA-723 investigation and further importing attempts of its kind from the company are to be seized and forfeited to the United States.”

Back on May 25, 2010, Hewlett-Packard Company and Hewlett-Packard Development Company, L.P. filed a lawsuit, claiming 7 companies infringed 6 of its US patent Nos.: 6,234,598、6,309,053, 6,398,347, 6,402,279, 6,412,917, and 6,481,817. The USITC instituted this investigation (No. 337-TA-723) on June 25, 2010 and issued a GEO on October 24, 2011.
