Recently, HP Inc. announced a favorable ruling to dismiss a patent infringement preliminary injunction by Memjet Ltd. The Court concluded in its ruling that the grounds for issuing the injunction were not satisfied, particularly as the HP PageWide XL products do not seem to infringe the asserted Memjet’s EP 1292451 patent.
“HP vigorously defends its intellectual property and is pleased with the court’s ruling in our favor,” said Thomas Valjak (pictured), Head of Large-Format Printing, EMEA, HP Inc. “We will now re-engage with our resellers and customers in Germany and offer HP’s PageWide XL printers and print heads that employ unique technology developed by HP over the last decades. HP’s PageWide XL products offer unique benefits in print speed, quality, reliability and usage cost.”
In November 2015, Memjet announced that District Court Munich I in Germany has granted Memjet a preliminary injunction against HP Deutschland GmbH, a German subsidiary of HP Inc., and primarily found that the German part of Memjet’s EP 1292451 patent has been violated by HP. The injunction affected HP Deutschland GmbH from sales of HP PageWide XL Series printers in Germany.
The same legal battle between HP and Memjet is also continuing in the U.S. market. On August 12, 2015, Memjet announced it had sued HP in the United States District Court for the Southern District of California. Later in October 2015, HP decided to countersue Memjet, claiming the printer manufacturer violates HP’s intellectual property rights.
